You simply cannot make this stuff up. Overreaching, outdated HOA needing to control people are just so ridiculous.

Most of the HOA board members are retired control freaks that hate any change or to stay current - all under the cover of "protecting the real estate value"...

I would imagine the original intent of the "rule" was to prevent people parking semis or commercial trucks in front of their house. Pickups are effectively passenger vehicles, unless used for commercial purposes. A lawyer should be able to sort this out for him ;)

nope. The only way to resolve this stuff is to move to a normal neighbourhood, and not one where you agree to draconian rules to live there…or get on the HOA board and change the rules.

That's the whole point isn't it.

One should not need a lawyer to park own personal vehicle on personal property.

Yet another artificially created problem that should not exist.

These type of rules are actually not that uncommon. They have grandfathered old HOA rules that outlaw 'commercial vehicles' and then they stretch how they define a 'commercial vehicle'.

I lived in an HOA in Unincorporated Portland (Cedar Hills) and they had a similar rule which meant I couldn't park my high roof cargo van in the driveway. My neighbor also got in trouble for parking his police cruiser behind a fence because it could be seen from the street. They even put a vote up to try and change the rule (only marginally) to allow passenger vans in case people had large families but it failed.

Yep agree, another reason not to buy property with an HOA

This is why I live in an area where everyone has acreage. I don't care what my neighbor does and he doesn't care what I do so long as we keep it confined to our own property.

Any HOA I've lived in allowed you to read the CC&R agreement before purchasing the property.

It's not even about the HOA really your agent should be able to get that info from the title company. For example if there are CC&Rs and no HOA or you can't get in touch with the HOA.

The CC&Rs for one my parcels of land I recently sold was written decades ago and it forbade the sale of the land to people of color. My point is the times change and cc&rs need to be rewritten. trucks used to mean work trucks. Nowadays they don't have fuck all to do with actually working.

The new report is kinda lame. It has nothing to do with this being an EV or Rivian just an outdated rule involving pickups.

Here in Colorado, we have Metro Districts. It’s worse than an HOA because it has taxing authority.

Okay, sorry for being that guy, but I think he should sell the truck. At the end of the story 1 thing glared right at me. And I think all you early VIN guys saw this too. You just wanted to be polite. It only has 1 magnet on the front trunk shelf holder. I mean seriously. Probably no 12v in front and plastic trim around the head rests.

Sorry, was this too soon for those that didn’t get an early VIN R1?

1. ESH (Everybody Sucks here in Reddit "Am I The Asshole" parlance.) Yes, the HOA rule is nonsense, but dude has a three car garage. He should be parking his $70,000+ vehicle in his garage. This is the owner purposefully making a stink and parking his truck outside to make a stink.

2. Similar lawsuits have been filed, and have found that these rules date from when pickup trucks were almost entirely "work trucks" and in the early 2000s, multiple court rulings found these unenforceable against modern pickups because they are no longer solely work trucks. The rule was meant to stop a window company owner from parking his work truck in the driveway.

I have a three car garage, the Rivian R1T won't be parked in it (if they ever build the Max Pack) as it is too long.

Builders don't put in large enough garages. I was spoiled by my previous home where the sellers had put in longer bays with room for tools and storage on the back and sides.
