Submitted my return on Oct 9th. So, 27 weeks and counting šŸ™ƒ I guess at least it's good it hasn't been outright rejected...
Iā€™m right there with ya - Oct 1 here A still waiting to be processed. Itā€™s there they acknowledge that.

Yes. Got my check with interest last week and sent in the amended return in late January. I selected a 2023 model, despite mine being 2024. Doesnā€™t seemed to have mattered.
Did you send it by mail or e-file thru Turbotax or something similar?

Turbo Tax isn't sure how to fix this. When I do it online, I don't have the option to select a 2024 model year.
I guess there should be a way to edit the form directly on TT. Did you talk to the TT support team?

Hi All,
My 2022 Amended Return claiming the pre-Inflation Reduction Act credit with the binding contract also got rejected, with this explanation: "because the vehicle placed in-service date is prior to January 1, 2023."

When I first read that, I thought "yeah, I know, that's why I filed an amendment for the 2022 tax period." Has anyone else dealt with this before? Could the IRS agent really have been so dumb as to not realize I was seeking to amend my return for 2022? Or is there something else going on that I'm missing?

I am going to appeal. Speaking of which, I could no longer find the Form 8936 IRS instructions that were in place when I filed the amendment, which said for Line 3 that "Taxpayers who took delivery in 2023 or after must use August 15, 2022 as the date placed in service when filling out Form 8936." It's like the IRS deleted it, even from the past versions of the instructions. Did anyone save a copy?

did you list the in-service date as 8/15/2022?

I contacted.. nice girl..said OK, I will push this through. That was about a month ago. It took an hour..45 minutes on hold..15 minutes of chatting.

Ah, maybe that is it. My CPA used the 1-2023 revised Form 8936 with my 2022 Amendment. It looks nearly identical, but not completely identical, to the 1-2022 revision of Form 8936. Would that be a basis for them to deny the credit because the in-service date is prior to 1/2023?

To follow up, the note at the top of the 1-2023 version says "This credit is for qualified plug-in electric drive motor vehicles placed in service before 2023, qualified two-wheeled plug-in electric vehicles acquired before but placed in service in 2022, and new clean vehicles placed in service after 2022." That sounds like it would apply to my R1S which was delivered in 2023 but for which I had a binding contract in early August 2022. But does it not apply for the pre-Inflation Reduction Act credit? Do I need to use the 1-2022 revision for that?

But according to this Credits for new electric vehicles purchased in 2022 or before | Internal Revenue Service (irs.gov) the date of binding agreement does matter.

Purchase date vs. delivery date
If you entered a written binding contract to buy a vehicle after December 31, 2021, and before August 16, 2022, but took delivery on or after August 16, 2022, you may elect to claim the credit based on the prior rules. To elect the credit under the prior rules you must elect the credit on your 2022 tax return after you take delivery of the vehicle. Depending on the date the vehicle is delivered, you can claim the credit on your original, superseding, or amended 2022 tax return.
