Yes exactly. Rivian did not promise a lot but what they did promise they could not deliver.

The only lawyer who sued tesla individually used an argument that tesla did not disclose you needed a safety score to use FSD beta

Before he sold his car, FSD beta required a safety score of 100. That was impossible to achieve and most owners cheated to get those numbers.
I was a pre safety score FSD tester in my Model 3. When we got the scoring system in wife’s Y we could not get a high enough score to get FSD beta no matter how hard we tried. Just going around curves dinged us.

See, I'm on the fence as a shareholder and enthusiast who's losing connection to the brand. I want to be made right for the lack of promised features that have made me bitter. There's also FOMO when they eventually win the suit/arbitration.

I'm leaning towards joining. Change my mind, folks!

I won’t be joining, I purchased my vehicle on what it could do when I bought it, not what it might do, that lesson was learned when I bought my Tesla. Besides the fact I got like a 20k discount when Rivian honored the initial prices. I know my not joining does nothing to improve the process but makes me feel better.

I really think they need to fix the broken legal system. I think people need to be limited to actual damages, I think lawyers need to have limit on the amounts they can get. I also think if you want to penalize a company to prevent further violations or bad behavior that money should go in a general fund that benefits society, maybe towards government debt or victim funds. Enriching individuals and law firms just promotes more lawsuits, especially when many settle because it is cheaper than fighting.

You agreed to arbitration when you didn't opt out of it after 30 days of signing the contract, so you can't sue them if you wanted!

You agreed to arbitration when you didn't opt out of it after 30 days of signing the contract, so you can't sue them if you wanted!
I actually agreed to arbitration when I signed the form, it was a conscience decision on my part.

Members get $.66 on the dollar for this one, pretty explicit.

It all echos back to the Rivian "s00n" movement: I'm willing to wait, just don't walk back after you take my money. Yes, $20k "discount", but then explicitly say that discount comes with lower capabilities.

Before we can file your claim against Rivian, we need some additional information from you (if available):
  • The year and model of your Rivian
  • The date you purchased/leased your Rivian
  • Copies all written contracts with Rivian, including:
    • Preorder/Reservation Agreement;
    • Configuration Terms and Conditions; and/or
    • Rivian Motor Vehicle Purchase Agreement or Motor Vehicle Lease Agreement
  • Please also confirm whether you exercised your “Opt-Out Right” as set forth in the “Dispute Resolution – Arbitration and Class Action Waiver” provision contained in Rivian’s purchase/lease agreement and its General Terms. If you elected to opt-out, please provide a copy of your opt-out communication with Rivian (e.g., the email you sent to [email protected] or any other similar written or electronic communication with Rivian).
Once we have this information, we can move forward (with your permission) with notifying Rivian and filing your claim. Accountability 101: don't explicitly advertise a product with "features coming s00n" if you can't provide.

The article mentions that RJ said in 2022 Rivians would be “limited to Level 3” self driving.

Regardless of what RJ said, I dug up prior versions of Rivian.com website to see what they said about Driver+ capabilities.

I noticed a few things:

1. “More road types introduced over time”, suggesting more road types than highways. Also, the picture depicts the driver without hands on the steering wheel, which never actually happens with Driver+.

2. Driver+ claims to deliver “true hands-free driving assistance.” Nothing about Driver+ is hands free today

3. “Lane change assist: assisted lane changes on the highway”. Currently, the driver has to do all lane changes—no driver assistance at all here.

Personally, I’m interested in seeing how this lawsuit evolves. I wouldn’t say it has no merit.

At minimum, these are the things Rivian said in print on their website about their Gen 1 driver+ capabilities. They haven’t delivered on these. If they delivered on “true hands free” driver assistance and more road types than the existing mapped roads, then I think they would have fulfilled their statements.
