I get the pushback, but that's not how contracts work. They aren't frozen at signing. A company's own statements and conduct after the fact can modify, waive, or add to the deal. And this wasn't some random person on a forum sharing an opinion, it's XCare's Founder and CEO publicly announcing how the company will handle claims for anyone who purchased coverage on or after November 1, 2025.
On the "hearsay" point: hearsay is a rule about what evidence gets admitted in court. It has nothing to do with whether a statement carries legal effect. When an executive speaks publicly on behalf of the company, that statement can come into evidence and carry real legal weight. But the bigger point is simpler than that: XCare made an official public commitment, and customers are entitled to rely on it.
We stand behind that commitment and will administer eligible claims consistent with our CEO's public statement.
