I'm not sure they can legally sell it if the VIN was indicating a specific model. They could say the SW unlock comes with it the car, but I haven't seen official guidance on how this will work. It definitely doesn't make sense for leases that won't be bought out.

In the OPs scenario, the car is not using the data connection Rivian provides. It’s connecting via WiFi to the drivers phone. Whether it’s more or less data, the car is using the phone plan the driver is paying for, not the LTE connection from the car.

Anything that uses internet should not be paywalled, but Rivian seems to have done that with Satellite map views and Gear Guard Live. If we are tethering through phone or dedicated MiFi device...
Cars like the GLS, Land Rovers, Q7s to some degree, X7, etc all have survived at the price point and market that Rivian is aiming for. If you only compared similar cars and usage, Rivian is doing very very well. There are more R1S in my area newer GLSes. I hardly ever see a X7.
