. I don't think we're going to get a magical trade in to a new vehicle.
Hire an attorney, start a lawsuit, and you might be surprised to see what happens. I'm going through it currently, DM me if you want. My situation is a tad different though.

^ at least Rivian is still in business.. you could have bought a Fisker, then you would have no one to sue :(
Fisker shouldn't be a benchmark for anything except for design language and ability to light cash on fire.

Rivian is just keeping it's head above water as is, expending lots of cash on devs and hardware upgrades on Gen 1 vehicles could put a huge burden on them with no upside (as far as added income is concerned).
Well, they shouldn't have promised it then, should they?

There is no doubt that it has value and it was used in the marketing material for the sales of Gen 1 vehicles. Like it or not, this is a liability for Rivian, and it needs to be addressed.

That said, we may learn that 'addressing it' is the powers-that-be inside of Rivian just hoping legal action isn't taken, and if it is, that the monetary and and reputational hit is preferential to the costs of actually addressing it to everyone's satisfaction.

Correction to my previous post, Tesla lost some individual law suits and there are a litany of class action suits in the works it seems.

In terms of class action this is a tricky problem. Tesla actually delivered with the FSD product more than was advertised. What people paid for is more than what tesla delivered.

The only thing is in 2018 for a very small amount of time, they sold a product which promised effectively level 5 autonomy. The amount of people who purchased that product and still have their car/not upgraded to HW4 is probably very low at this point.

50% drop in market value is not winning. Id say Tesla is losing very badly right now. It’s gonna be hard to shake that stink off.

Have no clue if this was driver error or FSD but clearly that is a Tesla that drove into the top of a flipped semi on I95 south in New Haven CT last night. Someone/thing clearly could not see the wall in front of them.

The best part is when they back out the Tesla it leaves a perfect silhouette outline of the car, just like in the cartoons!
