Jeep got away with the third brake light on the tailgate, I don’t see why Rivian couldn’t make the light bar work with the brakes. More is better in this situation.
Jeep tops are removable. That may impact what they’re allowed to get away with.

Because the CHMSL is required to be mounted on the highest fixed portion. the roof comes off.

Many convertibles have it mounted on the trunk lid.

it‘s legal to obscure the CHMSL., so having the tailgate down and it being blocked is fine.

Since the R1T has the third brake light on the cab, it seems that the bar on the tailgate could still be part of the regular brake lights. No?

Bottom line? The brake lights are very small for this truck. Motorists would prefer to be seen when braking in snowy or foggy conditions.
