FWIW, that "and" is indeed important, but it's also a clause that's control by "In general", which indicates that what follows is not a hard rule that applies in 100% of circumstances. It is equivalent to "usually", which, again, suggests that there are other facts that could meet the definition.

We simply will not know unless IRS issues further guidance, someone gets an audit letter or other letter indicating an improperly-claimed credit, or the SCD passes from our individual filings to be pulled for audit or otherwise reviewed/challenged by Treasury.

Audits rarely happen during filing season, but generally happen within one year of the date the return is filed. But the IRS can start an audit up to three years after the filing date.

I would think that if everyone with a PBA amends their return or files following the guidance, we would all fall under the same ruling.
It would be a lot of audits and many upset Rivian customers.

FWIW, here's the clarification from my guide when I asked about eligibility for EV credit having taken delivery in May 2023 (VIN 2023 MY) with a signed binding contract back in Aug'22.

Wow, that's awesome! I transmitted my amended return on 03/06/23 and still haven't received it yet. It's indicating 16 to 20 weeks on irs.gov's "where's my amended return" before release.
Hope your case is not a fluke on timing.

Just filed our amendment (TurboTax). Had to select paper check to be able to submit. I was told it should be 20 weeks until we get the check in the mail.

I signed the BPA.
Date Plug-In placed in Service - 8/15/2022
Date Acquired? This is the date we picked up the car from Rivian, or it's also 8/15/2022? it says it cannot be later than the date plug-in placed in service
