Unfortunately not only is Rivian totally not responsible for this, by stating that you didnt have your eyes on the road, this has now become all your fault. I cannot see a world in which the other driver is found to be at fault while you were not looking at the road, and in your own words `Any human driver would have seen the truck merging in due to the slow speeds and yielded to avoid an accident,` - sorry dude, just be thankful it seems the only damage was to property.

Sadly, this is why Level 2 ADAS is problematic. It requires constant attention by the driver, but it's often "good enough" that the majority of users trust the system to behave as-intended and as a result pay less attention than they should. If the ADAS isn't good enough, people won't use it...too good and they become inattentive.

Are you sure it's your fault. You were in the lane and the truck merged into your lane. I am not sure about your local traffic laws, but seems like the merging truck did not yield for you as you have right of way in your lane.

Unless your traffic laws have definite rules that require you to yield for merging vehicles, the truck that hit you should be at 100% fault regardless of circumstance.
Last clear chance doctrine...

Gen1 yesterday in HOV lane on highway veered towards the staggered concrete barrier but it's done it before on other sections and I always have my hands on the wheel. Of course it cancelled Driver+ and I was luckily ready for it but the feeling really sucks and makes me not trust it in the HOV lane. My concern is for new EV drivers that would definitely not be ready for that situation after being sold on Driver+ despite being told to always control the wheel. It's not a subtle pull towards the object, it's pretty harsh from my experiences.
Happens to me all the time in the HOV lane too.

OP-sorry to hear this happened. Good on you for stepping up. Great idea to share with Rivian so improvements might be made. I'm absolutely unqualified but would guess the idiot merging into your lane would be at fault. All the best.

Sorry to hear you had an accident. I'd be curious to know the parameters around why it didn't stop. From my experience, I haven't had a time where the ADAS didn't slow for the merging traffic.

As much as Rivian tries to limit the ADAS system, this kind of accident is inevitable. If trying to avoid getting these news is Rivian‘s reason for its conservative development on its ADAS system, I think they are wrong. I remember Rivian tried to advertise “slow development on ADAS” as a feature. Might as well don’t say anything about it if they are not developing it. Don’t give false hope to customers and then decide to not fulfill it in a timely manner.

Yet another case of autonomous driving functionality being blamed for inattentive driving. This situation is not the fault of the vehicle, it is clearly the fault of the operator who had their eyes off the road long enough to not see a yielding vehicle in front of them.

I had Driver+/Autonomy engaged during heavy traffic that was moving at about 5-10 mph. I then took my eyes off the road and shortly after was met with a strong jolt as if I had hit a wall to my front-right. To my horror, some work truck tried to slow merge into my lane and I had hit its side. Any human driver would have seen the truck merging in due to the slow speeds and yielded to avoid an accident, but after reviewing the incident video, Rivian's Driver+/Autonomy kept driving forward even as the truck began its merge. It's like it didn't even see the truck since it wasn't completely in the lane yet. And the anti-collision feature didn't even activate.

Front right quarter panel is wrecked and ugly along with other scratches and dings – vehicle still seems to drive fine at least. I'm so mad at myself for placing that much trust into the system. I suppose I also had the assumption that the vehicle would at least brake hard if it was about to collide with something while in Autonomy, which didn't happen. I have the incident video that I can PM to anyone that's interested.

Any chance that Rivian has liability in this scenario?

Personally, I would not post "i'm at fault" out in the public and ask insurance to review if the truck merging is at fault (from the video).

As for everyone here throwing the book at OP, relax, you're not his DAD!
