Hi all, if anyone is still following this, I just received my approval letter 12 weeks to the day after submitting my protest letter. I did not have the door jam available (sold that R1S and purchased another) so just used a photo copy of the GVWR from the owner's manual. It was frustrating to be realistically unable to communicate with CDOR. Phone always busy, appointments not available, never responded to emails. Hope everyone is having luck getting this sorted out. I think next year will be better for anyone purchasing again.

I hope so, but I wouldn't hold my breath on it getting better. They've been defensive at best in all the media I've seen on this EV credit issue. It's occurring to folks other than Rivian owners too. Hard to fix a problem they don't acknowledge. Sadly, the CO DOR gets more difficult to deal with every year - of course CO tax code has been getting more complicated every year as well.

Sorry about that, but I’m hardly surprised. There seems to be some crossed-wires between those who legislate the credits and those who issue them. What is most frustrating is that they don’t tell you exactly what their issue is. You’re supposed to guess until Channel 7 News (if they still exist) does an investigative report.

Did you pick the correct Category 7 (Light Duty Electric Truck) for vehicle type? I so it probably is just them being dumb yet again ?

I submitted my Tax return on February 22nd, Federal got deposited on March 7th, State got deposited March 10th. Got the full $5k from state, and $3750 from Federal. Total refund for me was just shy of $11k.

On your submission, they are specifically looking for the Yellow piece of paper marked as Bill-Of-Sale. It is a carbon copy, tear off, style of document.

I went thru my normal accountant, and he has seen many of them being rejected for lack of supporting documents. He was told directly by the Colorado DOR that any submission without that document will be rejected.

I'm glad to hear that, as that's the document I attached. I filed last week so hopefully it goes through without issue. I'm still waiting on the status of my amended 2022 federal return to change from 'received'. They received it in November.

I am happy to include my Bill of Sale in the protest, but nothing in the DR 0617 form instructions mentions needing that nor does the TPI-MA letter. Also if someone were to have leased, they should still be eligible for the tax credit but wouldn't have gotten a Bill of Sale.

@TollKeeper, did the registration you uploaded specify a GVWR? Mine did not and is my current theory about why the computer rejected it. Or maybe different software i.e. tax preparer eFiling software vs. TurboTax eFile vs. the state's free website (RevenueOnline). I used the latter. I also uploaded everything in a single PDF, am wondering if separate PDFs would be better to allow their SW to more easily OCR scan for GVWR etc.

Below is what I am aware of about the documentation they asked for.
  • DR 0617 Instructions: "You must submit the completed form DR 0617, along with copies of the vehicle registration and vehicle invoice, purchase agreement, or lease agreement with the income tax form (DR 0104, DR 0112, etc.) on which you are claiming the credit."
  • TPI-MA rejection letter: "The credit has been disallowed. The Gross Vehicle Weight Rating (GVWR) was not in the allowable range for the vehicle type selected. If you disagree,please provide all necessary documentation (purchase or lease agreement, Colorado motor vehicle registration, and window sticker) for the qualifying vehicle along with a copy of this letter. For additional information see Income Tax Topics: Innovative Motor Vehicle Credit. • The Innovative Motor Vehicle and Innovative Truck credit has been adjusted. The amount claimed on Form DR 0617 exceeds the maximum allowable credit. For additional information see Income Tax Topics: Innovative Motor Vehicle Credit."

My registration does have the vehicle weight on it of 6891 under the Empty Weight. But is also blank under the GVWR.

I decided to call them, and the guy looked over what I had submitted with the return and said it should be good enough for the EV credit team to review. He did suggest uploading the Monroney sticker so I went ahead and did that. But otherwise I apparently don't have to file a protest as he said him poking the team to review did the same thing. Apparently it is early enough in the filing season that it shouldn't take them long to review and fix, we'll see.

It's a shame we can't figure out why these aren't getting through the automated system. I doubt the Monroney sticker is a factor because while the TPI-MA letter asked for it as part of a protest filing, I don't see it mentioned as being necessary in any document I could have come across when preparing to initially file. I also don't know why the Monroney would be important as it doesn't show GVWR or I think any other info of importance that wouldn't already be shown on the contract, registration and door jamb label.

Too bad Rivian can’t file it themselves. You get extra money if it’s done at POS. Tesla figured it out.

I had similar issues with my Kia last year and it was a lease too. We got it in 2023 before they started offering it at POS.

I really think it would be easier for everyone if they just offered state sales tax exemption for EVs. Then it can be done at POS even easier and less paperwork.

I got a TPI-MA letter rejecting the credit today as well. I was going to respond online but maybe I'll try calling first based on your results. What number did you call?

https://tax.colorado.gov/contact-us-by-phone -> 303-238-7378, said "Agent" to the computer then hit 1,1,1,4,0 through the phone tree, then my SSN when prompted, then waited about 5 minutes on hold before it gave me the option to get a callback. I accepted and got a callback about an hour after I first called in, which I think was around 1pm.

I called today (several times while the system said it was experiencing technical difficulties when I entered a callback number; it finally worked) and talked to someone today. All my info was correct but he asked if I could email a copy of the purchase agreement from rivian and the full year registration (I just got updated registration). It sounds like the automated system rejects these for some reason and hopefully it will only take a few weeks for someone to review and approve it.
